We have successfully represented a licensee in an objection to an application by another licensee to trade temporarily from premises near to our Client.
In what is believed to be the first case on this point in Northern Ireland, we were able to successfully argue that our Client was entitled be heard notwithstanding the fact that the licensing legislation did not specifically provide for a right to object. Specifically the Court accepted that the European Convention on Human Rights required that an objector be heard where its legitimate commercial interests were under threat.
